The record: The plaintiffs visited in August 2022 and allege the hospital was “a complete construction mess” — as it had been for more than five years. Only one wing was working, with a run-down malaria clinic on the first floor, primarily treating local schoolchildren. No cancer treatment facility existed. The complaint calls the hospital “simply a shell” and “a mere ruse.”

2. “Julius built an energy-efficient, self-sustaining city in his hometown in Kenya.”

Claimed by: Julius Mwale, repeatedly from February 2022, per the complaint.

The record: The August 2022 visit found, per the complaint: the “luxury golf course” unfinished with no clubhouse and greens with no holes; the “rental homes” for farmers were vacant 10×10 concrete boxes with no facilities and no occupants. The complaint states the contrast “conveyed the clear impression” the project was a facade.

Claimed by: The Mwales, introducing their team to the Shaws.

The record: Per the complaint, “Derek William” is actually Derek William Knox — Kaila Mwale’s brother — who lives with the Mwales and, the plaintiffs allege, does not own KE International. KE International was presented as an “independent, third-party” contractor.

Claimed by: The Mwales, displaying wealth to the Shaws from February 2022 onward.

The record: The complaint lists the wine collection, jewelry collection, and cars among the alleged misrepresentations used to induce the $1.7 million investment — and separately alleges the jet was leased and the estate not owned. The underlying collections themselves have not been independently inventoried; what is documented is that the trappings of ownership were presented as owned wealth while, per the filings, key assets were not owned at all.
